Ankura, Inc. ("Ankura," "we," or "us") is committed to protecting your privacy while you use Ankura's MIXM™ software and services (collectively "Ankura MIXM™") through the MIXM™ web site ("Web Site"). This Privacy Policy is incorporated by reference into Ankura's Terms of Use ("Terms of Use"). We therefore encourage you to read this Privacy Policy to learn of our practices regarding the use of Ankura MIXM™ and the Web Site. Because this Privacy Policy may change from time to time, we suggest that you check back periodically.

    Your use of Ankura MIXM™ is subject to Ankura's Terms of Use and this Privacy Policy. In case of contradiction between any express provision of the Terms of Use and an express provision in this Privacy Policy, other than a provision addressing privacy matters, the express provisions of the Terms of Use shall prevail.

    If you are not comfortable with all of the provisions of this Privacy Policy, please do not use Ankura MIXM™. By downloading or using Ankura MIXM™, you agree to be bound by the terms of this Privacy Policy. Your commencement or continued use of Ankura MIXM™ after a change in the terms of this Privacy Policy will be deemed as acceptance of the most recent version of the Privacy Policy. If you do not agree with changes made to the Privacy Policy, your only recourse is to discontinue your use of Ankura MIXM™ and the Web Site.

    You may cancel your Ankura MIXM™ account at any time and remove your information from Ankura's database. You may do so by following the instructions on the Ankura MIXM™ Support Page.



    1.  How do we collect user information?

    We gather personal information from users in a few ways.

    1.1.  Registration: When you download Ankura MIXM™ for the first time, you will be asked to submit personal data, including your full name and e-mail address, your gender, country, and zip code. The information is collected to identify you as a user, to store the Content you collect on your Workspace, and to contact you if, and when, necessary. In order to receive other specific services which are available through Ankura MIXM™ or the Web Site, you may have to submit additional information.

    1.2.  Updating registration information: You are solely responsible for keeping your registration information accurate and up to date. If you need to update or change your personal information, you may do so by logging into the Web Site and selecting "User Info" in Options.

    1.3.  Usage patterns: While you are using Ankura MIXM™, we will gather, with your permission, information related to your patterns of use of Ankura MIXM™, such as the URLs and addresses of the web pages you visit. You may disable this tracking feature by selecting "User Info" in Options.

    1.4.  User settings: Ankura does not collect user settings, such as your operating system, DNS number, IP address, software and browser versions, graphic cards, and computer chip. However, we reserve the right to collect such information in the future, and will post an amended to the Privacy Policy on the Web Site at that time. In no event will this information be linked to personally identifiable information.

    1.5.  Content: Information such as links, text, data, banners, graphics, pictures, files, messages, software, advertisements, products, and other types of information (collectively, "Content") you may want to collect and keep in your own workspace which Ankura provides for you ("Workspace(s)"), will be saved on our servers. To prevent loss of all or part of the Content in your Workspace, you may want to save the Content you collected in your Workspace on your hard disk as well.

    1.6.  Cookies: In order to enable the use of Ankura MIXM™, Ankura uses HTTP cookies which are installed in your computer's hard drive. Cookies are small pieces of information saved by your web-browser software. You may disable any use of cookies by selecting your web-browser's "disable cookies" function. Most commercial web-browser software packages have this function available for the user's selection. However, please note that disabling cookies in your web-browser software may deprive you of most of the benefits offered by Ankura MIXM™. Third party web sites you access through the use of Ankura MIXM™ may also use cookies. Ankura has no access to, or control over, cookies used by other web sites.


    2.  Do we share your information with others? Except as expressly provided for in this Privacy Policy, Ankura does not sell or otherwise share personally identifiable information to any third party. We will not disclose your name, or other personally identifiable information, or any Content in your Workspaces to third parties, except under the following circumstances: (a) as required to comply with applicable law, (b) upon your express consent or request, or upon your designation of your Workspace as "Public" (c) as necessary to resolve a critical problem with our servers, (d) as necessary to protect and defend the property rights and integrity of the user, Ankura, or other users, (e) if necessary, and to the extent necessary, to a potential purchaser of a significant part of our shares or business, or (f) to our business partners and affiliates. Notwithstanding the foregoing, Ankura reserves the right to use and disclose any aggregate information derived from the Registration Forms and Workspaces which does not contain personally identifiable information.


    3.  Do we have control over other web sites? You should be aware that by using Ankura MIXM™ to surf the Internet or to link to other sites, you will have access to web sites that are not affiliated with Ankura. Such web sites may have privacy policies and procedures of their own. Some of these web sites may place cookies on your computer or may seek to collect data from you. Ankura cannot and does not guarantee the security of any information that you disclose to, or that is otherwise obtained by, any third party web site. You expressly agree that Ankura shall incur no liability for the use or misuse of any information given to or collected by unaffiliated web sites.


    4.  How is user information being used?

    4.1.  Customized user experience: In order to improve Ankura MIXM™ and the Web Site, and to provide our users with more personalized services, we gather information about users' habits and needs. Learning about our users' preferences, demographics, and other information will enable us to add features and services relevant to specific users' needs and interests. If you do not want Ankura to collect your usage patterns, you may disable this feature by selecting "User Info" in Options.

    4.2.  Targeted advertising: Ankura may disclose non-personally identifiable user information and patterns in the aggregate to potential advertisers. For advertisers who contract with Ankura, Ankura acts as a "middle person" between the advertisers and the users. Advertisers give Ankura an advertisement and specify the type of audience they believe is likely to be interested in that advertising. We will then send the advertisements to only those Ankura MIXM™ users who fit the description and are interested in such information. Ankura will not, however, provide personally identifiable information about users to any advertisers. In addition, Ankura may use such user information or any part thereof for purposes such as marketing, promotion activities, rating, registration of products, etc. If you do not wish to receive targeted advertisements, you may disable this feature by selecting "User Info" in Options.

    4.3.  Communication/Support: Ankura may use your e-mail address to send you various types of information, including periodic updates regarding new Ankura MIXM™ features and functions. Any user may decide to withhold his/her consent to receive such information by opting out of this feature during registration, or by selecting "User Info" in Options.

    4.4.  Surveys: From time-to-time, Ankura may request information from users via surveys to improve Ankura MIXM™ and the Web Site. Your participation in the surveys is completely voluntary. You may choose to provide some or none of the information we request.

    4.5.  Content and making Workspaces public: Unless designated as "public," all Content saved in Ankura MIXM™ Workspaces is "private" and is only accessible to you or those persons with access to your password. Content saved on Workspaces designated as "public" will be placed in the Ankura MIXM™ library on the Web Site and may be retrieved by the general public. Any Workspace that is designated public will be posted in the Ankura MIXM™ library and will disclose the name of the creator of that Workspace, as well as when and where the Content was captured.

    4.6.  Content and information made available to other users: While we will use our best efforts to ensure that our users will respect the confidentiality of other users, Ankura is not and cannot be responsible, and shall incur no liability, for any breach of confidentiality or unauthorized use of information that you provide to other users or other third parties, either directly or through placement of Content on a Workspace.

    5.  Other issues you must consider when using Ankura MIXM™ and Web Site:

    5.1.  Internet use: By using the Internet, the Web Site, and/or Ankura MIXM™, you may be exposed to contaminated files, computer viruses, eavesdropping, harassment, electronic trespassing, hacking, and other harmful acts or consequences that might lead to unauthorized invasion of privacy, loss of data, and other damages.

    5.2.  Unauthorized access, release from liability: Persons may try to unlawfully obtain information in our servers, including personal details you may post with us. To protect your data in our internal networks and systems, we use standard security technology such as firewalls, authentication, proxies, and monitoring technology. Ankura's servers, on which all user information is stored, are kept in a secure facility. Only Ankura's employees who have been given a special password, and have become familiar with Ankura's Privacy Policy, have access to the information and only for the purpose of maintaining its security. Ankura's employees are kept up to date on Ankura's Privacy Policy. However, no security system is fully "bullet proof." You should be aware that when you send information over the Internet, the information may travel over systems that are not under our control, and that others may unlawfully intercept the information that you send and unlawfully access our databases. As such, Ankura does not and cannot guarantee that your information will be 100% secure.

    5.3.  You agree to hold Ankura and its employees, agents, and affiliates harmless for (a) any unauthorized distribution, disclosure, and/or use of the private information you provide to us, or post on any Ankura MIXM™ Workspace, by any third party, or (b) exposure to contaminated files, computer viruses, eavesdropping, harassment, electronic trespassing, hacking, and other harmful acts or consequences that might lead to unauthorized invasion of privacy, loss of data, and other damages. The above list is not exclusive.

    5.4.  Password: At registration, you are required to select a user name and a password. Your user name and password are used to verify that you are the only person accessing your account. You are solely responsible for maintaining and protecting the confidentiality of your user name and password. You are encouraged not to disclose your user name or password to any other person. Loss of your user name or password may deprive you from accessing the Web Site or any old Content you assembled, and from using Ankura MIXM™.

    5.5.  Opting out: Although Ankura must collect information in order for you to register and for Ankura to communicate with you, you may opt out of receiving regular communications or advertisements by modifying your Registration information. Users may opt out during the Registration process, or at a later time, by clicking on "User Info" in Options and selecting "Opt Out." Notwithstanding the above, users may not opt out of receiving certain announcements from Ankura, such as service and site updates.

    6.  Privacy and children: The Ankura MIXM™ Web Site is a general audience web site, and does not specifically collect information from or about children. Ankura recognizes the privacy concerns of parents, and the importance of protecting the privacy of information collected from children. Ankura's Web Site therefore fully complies with the Children's Online Privacy Protection Act. Ankura MIXM™ and the Web Site are available to children under the age of 13 only after we have received verified parental consent as part of the Registration Form. Ankura reserves the right to suspend the use of Ankura MIXM™ or access to the Web Site upon learning that a user is under the age of 13 until we receive verified parental consent. Ankura reserves the right to terminate the account of anyone under the age of 13 whose parent refuses to provide, or has withdrawn, such consent. Children between the ages of 13 and 16 are encouraged to discuss the provision of personally identifiable information with their parents before making any disclosures to Ankura or any other web site. Ankura recommends that parents and guardians use the available parental controls or filtering technology to supervise their children's web access.
